Terms of sale

The general ordering conditions apply to the legal relations arising from the ordering of products located in the e-store www.elamisekergus.ee (hereinafter referred to as the E-store) of Elamise Kergus OÜ (hereinafter referred to as Elamise Kergus) via the ordering environment.

In addition to these general ordering conditions, the relations between the Subscriber and Elamise Kergus are regulated by the legal norms in force in the Republic of Estonia and the procedure for processing the personal data of Elamise Kergus customers (privacy policy), available at www.elamisekergus.ee/privaatsus.

These general order conditions, privacy conditions and the valid price list of e-store products are available on the Elamise Kergus website.

Procedure for ordering products

To order products, the Customer does not need to register as a user of the Elamise Kergus e-store. The customer selects the desired product(s), determines the quantity of each product, the method of payment for the products and the method of delivery. Before the final confirmation of the order, the Customer can review the order and make changes.

When registering as a loyal customer before placing the order, all regular prices will have a -5% discount (not applicable for sale or campaign products). To receive the discount, one must perform the purchase logged in to his account.

The products sold on the e-store are either in stock (available quantity is shown at the product page), available for follow-up order or for subscription order.

Follow-up products are not currently in stock but ordered with regular stock intake. Subscription orders are a convenient way for reordering the same products after a certain time period.

The subscription order is placed once and it will renew automatically and will be fulfilled by Elamise Kergus. In order to pay for a subscription, one needs to insert bank card details in checkout. The payments will start recurring periodically. Also, shipping cost will be added to each recurring order. Subscriptions can be changed any time or cancelled after the second fulfilling.

All prices of the products shown in the e-store include VAT. The price of the ordered products is supplemented by the product delivery fee according to the delivery method chosen by the Customer.

It is possible to pay for the order confirmed by the subscriber to Elamise Kergus by means of Montonio Finance link, by Stripe credit card form, by Apple Pay / Google Pay or by bank transfer on the basis of an invoice.

When paying through Montonio Finance link you can choose between the following banks:

  • Estonian banks: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele, Revolut.
  • Latvian banks: Swedbank, SEB, Luminor, Citadele, Revolut.
  • Lithuanian banks: Swedbank, SEB, Luminor, Šiauliu Bankas, Medicinos Bankas, Citadele, Revolut.
  • Finnish banks: Nordea, Danske Bank, OP, Handelsbanken, S-Pankki, Oma Säästöpankki, POP Pankki, Säästopankki, Ålandsbanken.

Different “buy now – pay later” options are offered in the cart by Montonio Finance. The client can choose between either pay later (Pay in 1 month without any additional fees. 0% interest, 0 € contract fee and 0 € administration fee.) or pay in three instalments (Split your payment in 3 equal instalments without any additional fees. 0% interest, 0 € contract fee and 0 € administration fee.).

Elamise Kergus is responsible for processing the personal data that is necessary for making the payments and will forward this information to the authenticated processor Montonio Finance.

When paying with foreign bank card, the Stripe application requires relevant card information. The payment will be processed via secure SSL Secure Payment solution.

When paying by transfer from a foreign bank, one must also notify by e-mail address info@elamisekergus.ee after placing the order. Transactions are settled in Euros. The contract between the Customer and Elamise Kergus shall be deemed concluded after the Customer has confirmed the order and Elamise Kergus has forwarded the confirmation of the order to the Customer. The order enters into force upon sending the products to the Customer by Elamise Kergus.

Product delivery

Elamise Kergus will deliver the ordered products to the Customer according to the method chosen by the Customer when submitting the order, using Itella Smartpost, DPD or Omniva parcel machine, Omniva courier or DPD courier. The Customer may also pick up the goods himself at Elamise Kergus concept store from Monday to Friday 11:00-19:00, located at Kalaranna 8/2, Tallinn, 10145.

The method of delivery is chosen by the Customer when placing the order. Delivery prices are fixed in the price list, which is also visible to the Customer when placing the order.

Delivery prices:

Omniva parcel machine – € 2.71

Smartpost parcel terminal – € 2.84

DPD parcel machine & pickup – € 2.90

DPD courier – € 10.50

Omniva courier – € 7.50

It is possible to pick up the order yourself at Elamise Kergus concept store from Monday to Friday 11:00-19:00, located at Kalaranna 8/2, Tallinn, 10145.

For orders over €119, we deliver them to the parcel machine of customer’s choice free of charge.

Delivery prices outside Estonia:

Latvia – Venipak courier 8,40€

Lithuania – Venipak courier 9,60€.

All other European countries – 35€.

Product delivery time

The products are usually delivered to the Customer within 2-4 working days. In case of delays in delivery, the Customer will be contacted as soon as possible.

Itella Smartpost

When the parcel has been delivered to the parcel machine, the Customer will receive an e-mail and a SMS with a personal door code. To receive the parcel, one must enter the code on the parcel machine’s screen.

The parcel is held in Smartpost parcel machine for 7 days since receiving the SMS. The Client can prolong the period for another 7 days if necessary.

DPD / Omniva:

When the parcel has been delivered to the parcel machine, the Customer will receive an e-mail and a SMS with a personal door code. To receive the parcel, one must enter the code on the parcel machine’s screen.

The parcel is held in parcel machine for 7 days since receiving the SMS.

The consumer’s right to withdraw from the order

The Customer (hereinafter referred to as the Consumer) has the right to withdraw from the order of the products without giving a reason within 14 calendar days following the receipt of the products, but only if the product is unopened. In order to cancel the order, the Customer must contact Elamise Kergus by phone +372 5290139 or send a corresponding e-mail to info@elamisekergus.ee.

If the Consumer withdraws from the order, the Consumer undertakes to return the unused and undamaged products immediately, but not later than within 14 calendar days of submitting the withdrawal request. The consumer must return the products via the parcel machine or bring to Elamise Kergus concept store, Kalaranna 8/2, Tallinn, 10145.

Return of goods ordered via Itella Smartpost parcel machine:

The recipient can return the goods ordered from the online store to the sender within 14 days via parcel machine. The shipment can be returned with the same door code as upon receipt from Smartpost parcel machines located in Estonia. The ordered goods can also be returned according to the terms and price list of the Smartpost private customer.

  • When the parcel was delivered to the blue parcel machine, one can use the same door code for returning and make the return from whichever blue parcel machine located in Estonia. The parcel can also be returned from the white parcel machine, if the return has been formed at my.smartpost.ee self-service environment according to the (barcode) number of the parcel.
  • When the parcel was delivered to the white parcel machine, then the return must be formed at my.smartpost.ee self-service environment according to the (barcode) number of the parcel. One can choose between returning to either white or blue parcel machine.

Return of goods ordered via Omniva parcel machine:

The customer returns the ordered goods to Elamise Kergus via the parcel machine according to the conditions and price list of the private customer or by using the return code that was stated in the initial SMS received.

Return of goods ordered via DPD parcel machine:

The customer returns the ordered goods to Elamise Kergus via the parcel machine by using the return code that was sent to customer shortly after taking out the initial order from the parcel machine. The return code is valid for 14 days. Parcels delivered by courier can be returned only by parcel machine.

In all return methods, the Consumer shall bear the costs of returning the products upon withdrawal from the order. If the Consumer uses the return door code for return, the cost of sending the returned order will be deducted from the amount of the order returned to the Consumer. 

Elamise Kergus returns to the Consumer the amount paid for the returned products and the delivery fee to the extent of the amount paid by the Customer but not more than the most favorable price for the mode of transport chosen for delivery in the area. If the Consumer partially returns the ordered products, Elamise Kergus will not refund the delivery costs. Elamise Kergus will refund the money no later than within 14 calendar days of receiving the notice of withdrawal but not earlier than within 3 working days from the receipt of the products returned by the Customer. Elamise Kergus reimburses the costs of shipping to the Consumer in full if the reason for withdrawal is a defective or incorrect product.

If the product returned by the Customer has been used, Elamise Kergus has the right to demand compensation for damage to the extent of the sale price of the product. This amount will be deducted from the amount returned to the Customer.

Consumer rights

The customer has the right to order products from the e-store at the price and under the conditions set by the Elamise Kergus. The product sent to the Customer must be correct and complete and meet the conditions set by the Elamise Kergus.

In the event of a defect, the product will be replaced by the same product, unless the product is no longer available for sale. If the respective product is no longer for sale, the product is replaced at the choice of the Customer or the sales contract is terminated, and the cost of the product is returned to the Customer. The customer has the right to rely on the legal remedies provided by law in case of non-compliance of the product with the terms of the contract.

Consumer obligations

When placing an order, the Customer is obliged to provide the information necessary for the execution of the order: first and last name, contact telephone number and, if possible, the e-mail address.

If the Customer and the recipient of the product are different, the Customer must also provide information about the recipient. If the information provided by the Customer is incorrect and/or incomplete, the Ease of Living does not guarantee the proper fulfilment of the order. If possible, Elamise Kergus will contact the Client to specify incorrect or incomplete information.

When placing an order, the Customer confirms that he/she agrees with the conditions set out in these general order conditions and undertakes to comply with them.

Rights of Elamise Kergus

Elamise Kergus has the right to change these general terms and conditions without prior notice by publishing new valid terms and conditions in the online environment. Elamise Kergus has the right to change the price list of the e-store at any time without prior notice by publishing a new price list in the Internet environment. Elamise Kergus has the right to refuse to accept or fulfil the order, for example, if the wrong price is erroneously published in the price list.

Obligations of Elamise Kergus

Elamise Kergus undertakes to deliver correct and complete product (s) to the Customer and to receive and document all claims of the Customer. Elamise Kergus undertakes to resolve the Customer’s claim within 7 working days if the reasons for the claim are independent of the Customer. If the cause of the claim is caused by the Customer, the Customer must eliminate it immediately. Elamise Kergus undertakes to replace defective products.

All disputes between the parties shall be settled through negotiations. If no agreement is reached and the Customer wishes to continue filing a complaint, the Customer has the right to contact the Consumer Disputes Committee of the Consumer Protection Board at Rahukohtu 2, Tallinn 10130 or at web site www.komisjon.ee. The Consumer Disputes Committee is competent to settle disputes arising from a contract concluded between a consumer and a trader, which the parties have not been able to resolve by agreement. The examination of the complaint in the commission is free of charge for the parties.
